Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Ascenta Studio ("Ascenta", "we", "us"), a brand operated by La Factoria LLC, a Delaware limited liability company with its registered address at 8 The Green, Ste B, Dover, DE 19901, USA. By engaging our services or using this website, you agree to these Terms.

1. Services

Ascenta designs and builds websites, online stores and animated hero sections. New projects are quoted individually. The written quote defines deliverables, exclusions, required materials, revisions, schedule and total project price. Integration with an existing platform requires confirmed compatibility and access.

2. How a project works

We clarify your requirements and confirm the scope, price and schedule before payment. Work starts after acceptance, payment of the agreed project fee and receipt of required materials. You review the work and approve launch. The quote specifies included revisions; additional requests require a separate quote and your approval before work begins.

3. Fees and billing

• The agreed project fee is paid in full before work begins, unless your accepted written agreement specifies another payment schedule. Fees already paid are non-refundable.
• Your quote lists hosting, domain, technical maintenance and third-party costs separately, including required recurring charges and optional services. No universal maintenance fee applies to new projects.
• The accepted price remains fixed for the agreed scope. Our own estimation error does not increase that price. New requests or scope changes are quoted for approval before additional work starts.
• Previously accepted quotes and agreements retain their agreed prices and terms. This pricing change applies to new engagements and does not replace existing agreements.

4. Ownership

Your content — your business name, logo, text, photos and any material you provide — remains yours. Once the setup fee is paid, the website design and code built for your site are yours as well.

5. Your responsibilities

• You confirm that the content you provide is accurate and that you have the right to use it.
• You will not use the website for unlawful purposes or content.
• Domain names registered on your behalf are registered in your name or transferred to you upon request. Domain registration and renewal costs are detailed in your quote.

6. Hosting

Your quote specifies the hosting arrangements, included services, usage limits and any recurring or third-party costs. If you want to host your site elsewhere, we provide the website files and assist with the agreed domain transfer or pointing. Existing hosting agreements retain their terms.

7. Warranties and liability

We build to a high professional standard, but services are provided "as is" and we do not guarantee specific business results, search rankings or uninterrupted availability. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect or consequential damages.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or on this page. Continued use of the services after a change constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
